After a detailed Phase II investigation, the European Commission has cleared the proposed acquisition by Newscorp of Italian pay-television company Telepiù from Vivendi Universal. Telepiù will be merged with Stream, the other pay-TV company in Italy, thus creating a near-monopoly in Italian pay-TV. The new entity will be controlled by Newscorp with Telecom Italia maintaining a minority stake. We provided economic advice to Newscorp and Stream throughout the Phase II proceedings, on issues including 'failing firm defence', and economic rationale for the remedies volunteered by Newscorp.
