South African Supreme Court of Appeal Cites Study in Setting Aside Regulations on Pharmacy Dispensing Fees

The South African Supreme Court of Appeal (the second highest court in the country) today set aside regulations on pharmacy dispensing fees that had been recently promulgated by the South African Department of Health. In reaching this decision, the presiding judge emphasized an expert report submitted by Dr Robert Stillman that the court described as "based on a careful and detailed analysis of factual data" and which concluded that the proposed fees "will not provide pharmacists in any of the sectors analysed with sufficient revenues to cover their operating costs".
