Court of First Instance rejects Microsoft's application for Interim Relief

We assisted the Computer & Communications Industry Association (CCIA) and their counsel with economic advice on interoperability issues in their submissions as intervener in support of the European Commission in the Interim Relief proceedings brought by Microsoft for suspension of the EC Decision adopted on 24 March 2004.

The European Commission Decision of 24 March 2004 required Microsoft to bring to an end their behaviour in breach of Art. 82. Inter alia, Microsoft was ordered to supply information on their communications protocols that would allow non-Windows work group server operating systems to interoperate with Windows PCs and Windows work group servers. Microsoft lodged an appeal against the EC Decision on 7 June 2004 and separately, applied for Interim Measures suspending the EC Decision until the outcome of the main appeal is known. On 22 December 2004, the Court of First Instance dismissed Microsoft's application for interim measures in its entirety.
