On 3 September 2009, the Autorité de la Concurrence (the French competition authority) published a decision rejecting the request of interim measures by the generic pharmaceuticals firm Ratiopharm against Janssen-Cilag, an originator pharmaceuticals company. The Authority decided that the case will require an in-depth investigation.
Ratiopharm claimed that Janssen-Cilag used its dominant position to stop it from entering the market, by putting pressure on the Sanitary Authority (AFSSAPS) to prevent or delay Ratiopharm's Marketing Authorisation; denigrating Ratiopharm's product; and giving Durogesic patches almost for free to hospitals (predatory pricing).
CRA assisted Janssen-Cilag in responding to the predatory pricing allegation. The CRA team was composed of consultants from the Competition and Life Sciences practices led by Laurent Flochel and included academic associates Prof Pierre Regibeau and Thibaud Vergé. The Life Sciences team was led by Tim Wilsdon and Anisa Berdellima also assisted on the case.
