The European Commission has unconditionally cleared Caterpillar's proposed acquisition of MWM, a German maker of reciprocating engine generator sets, or gensets, used for decentralised electricity production, after an in-depth Phase II investigation. While the Commission considered that the merged entity would be "a formidable force to be reckoned with", it accepted the merging parties' argument that they were not particularly close competitors in the supply of gensets and that sufficient competition would remain post-transaction. A copy of the Commission's press release announcing the clearance can be found here.
A team from Charles River Associates in London and Brussels, led by Matthias Pflanz and Dan Donath, assisted MWM and MWM's owners 3i in the Phase II proceedings before the Commission.
