EC clears INEOS's acquisition of Tessenderlo's S-PVC Assets, following a Phase I investigation

The European Commission has unconditionally cleared the acquisition of Tessenderlo's S-PVC Assets by INEOS following a Phase I investigation. Both parties are active in the production, marketing and sale of polyvinyl chloride (PVC) and caustic soda. The Commission was concerned about the impact of the transaction on sales of commodity Suspension PVC (S-PVC) mainly in North West Europe and the UK. Despite concerns from customers about further consolidation in the S-PVC market, the Commission concluded that the transaction will not reduce competition, because the parties are not each other's closest competitors, customers tend to multisource, and there is significant spare capacity on the market.

Cristina Caffarra, Dan Donath and Ian Small assisted the parties in the European Commission proceedings.

See Commission press release for further details.
