In July this year, the online daily fantasy sports sites Fan Duel and Draft Kings called off their planned merger in the face of FTC opposition. The FTC merger review raised interesting and novel questions about the role of antitrust in digital markets. Ultimately, however, the review and subsequent challenge pivoted on a traditional merger guidelines analysis of the relevant product market and entry conditions.
