Richard M. Franciosa is an associate principal in the Intellectual Property practice at CRA. Mr. Franciosa has been responsible for significant client assignments in a wide range of areas, including intellectual property, damages, and valuation. These services have been provided in industries such as for-profit education, financial services, consumer electronics, apparel, transportation, telecommunications, medical devices, and defense. Mr. Franciosa has participated in various stages of the litigation process such as preparing expert reports for state/federal courts and arbitration, evaluating liability and damages claims, assisting in deposition and trial/arbitration support, and developing presentations and financial models for settlement discussions.
Mr. Franciosa’s experience in litigation matters has included assisting counsel and clients in determining the appropriate economic measure of damages, such as lost profits and reasonable royalty and increased costs, in breach of contract, patent infringement, false advertising, and other commercial disputes. These engagements often entail a review and analysis of cost structures, business models, capacity issues, agreements, industry data, and surveys.
Prior to returning to CRA, Mr. Franciosa worked at IP Navigation Group, a patent advisory start-up, where he led and implemented a patent valuation process to complement an existing patent analysis process. He valued patent portfolios for acquisition and monetization purposes, and communicated findings for FRE 408 settlement discussions. Prior to joining IP Navigation Group, Mr. Franciosa worked at CRA specializing in patent strategy, management, and damages.
