Aaron Edlin and Carl Shapiro, along with Scott Hemphill and Herbert Hovenkamp, published an article entitled “Actavis and Error Costs: A Reply to Critics,” which appeared in the October 2014 issue of The Antitrust Source. In the article, the authors defend their previously published analysis of the Actavis decision and argue that their proposed framework is supported by both the Supreme Court’s decision and economic theory.
