Client issue: A wireless technology leader sued a filter company in federal court, alleging misappropriation of over 36 trade secrets and infringement of patents related to advanced radio frequency filter technology. The filter company denied the allegations and challenged whether the wireless company had taken “reasonable measures” to protect its trade secrets.
CRA approach: CRA’s Forensic Services testifying expert analyzed the wireless company’s information security program and the broader evidentiary record. At trial, our expert provided independent expert testimony that the wireless company had implemented reasonable and effective safeguards to protect its trade secrets, rebutting the filter company’s claims.
Client impact: A Delaware federal jury found that the filter company had willfully and maliciously misappropriated the wireless company’s trade secrets and infringed two of its patents. The jury awarded the wireless company $31.5 million in compensatory damages and $7 million in punitive damages, validating the integrity of its intellectual property protection efforts and supporting a significant legal victory.
