Retained to help joint venture partners resolve complex disputes in International Court of Claims

CRA Forensic Services expert Kristofer Swanson was retained by Seyfarth Shaw LLP to help two joint venture partners resolve – via international arbitration – a series of unusually complex disputes arising from the fracture of a multi-billion dollar, three-decade long manufacturing and marketing relationship covering all of North, Central, and South America. In support of an International Chamber of Commerce, International Court of Arbitration proceeding, Mr. Swanson responded to multiple other expert witnesses by investigating and issuing three expert reports on damages, GAAP accounting, cost allocations, intercompany pricing, and unlicensed sales on the grey market. His analyses contributed to a very successful resolution of the dispute by the business, including a payment of approximately $300 million in exchange for the acquisition of certain factories and the execution of intellectual property licensing and supply agreements.
