Secured favorable settlement through AI discovery in data scraping dispute

Client Issue:
A large data management company faced a multi-million-dollar breach of contract lawsuit over alleged data scraping. The plaintiff demanded discovery of years of system logs and data across multiple platforms that had undergone significant changes over time. With trial risk mounting, the client needed a strategy to manage massive data production while building an effective defense.

CRA Approach:
A CRA team approached the challenge from multiple angles. First, our expert analyzed the technical blogs and public disclosures the plaintiff had published before the dispute, giving us insight into how their systems worked. This research, which focused on pre-dispute documentation for neutrality, helped us structure more targeted interrogatories and prepare counsel for depositions of plaintiff representatives. Simultaneously, we tackled the massive data production by developing a bespoke sampling strategy that reduced the review time, while maintaining statistical validity. We also deployed AI to rapidly categorize documents produced in discovery, identifying key themes within weeks, and allowing us to focus our analysis on the most relevant issues.

Client Impact:
Our work led to a favorable settlement before discovery concluded. The client avoided months of expensive discovery battles and the uncertainty of trial, gaining closure instead of facing a potentially costly courtroom outcome.

Relationship Context:
This was a new client for the team, and the client selected our expert and team primarily based on the team’s credentials and the pre-engagement research we conducted under a tight timeline, which demonstrated our expertise and agility.
