Software copyright reasonable royalty analysis

CRA was retained by a large government agency accused of infringing copyrights related to document imaging and indexing software.  CRA provided an expert report and deposition testimony regarding the determination a reasonable royalty under multiple scenarios of alleged infringing use.  CRA’s reasonable royalty analysis included an evaluation of the functions, features and benefits of the copyrighted software, an analysis of comparable software licenses, and the determination of expected terms for the hypothetical license, including expected discounts (both reseller and volume-based) and expected software maintenance revenues.
