Is the fast-moving AI industry becoming more concentrated or less concentrated? What are North American antitrust agencies currently focused on with regard to AI? The FTC’s and DOJ’s existing main Section 2 cases against big tech companies are several years old, and since they were originally researched and brought about, the arrival of generative AI has fundamentally changed the competitive landscape. Future cases against digital companies, if they arise, will probably concern dominance in AI itself. What will be the next generation of tech cases?
