Arthur Baines is a presenter during the session titled “Back to the Future: The Return of the Dealer Reserve as a Fair Lending Issue.”
Description: In indirect auto finance, the practice of auto dealers negotiating the interest rates on their retail installment contracts has drawn waves of fair lending criticism, beginning with private litigation in the late 1990s and continuing with a series of CFPB and DOJ enforcement actions between 2013 and 2016. Now, however, the issue is back in the hands of state regulators. This panel will walk you through the history of this issue and discuss the dangers that it continues to pose for indirect auto finance companies.
