Chris Rucinski moderates the session titled “Take Down the Takedowns? The Future of Takedown Notices in the Wake of Cox.”
The Supreme Court’s recent decision in Cox v. Sony Music set standards for platform contributory liability so that online platforms must be shown to be “inducing” or “tailored to” infringement to be found liable. This calls into question the systems for sending and processing takedown notices that were developed since the enactment of the DMCA in 1998 – systems such as those that generated the thousands of takedown notices that Cox was accused of ignoring. Our panelists will contemplate the future of such mechanisms and the cottage industry that has developed to support them.
