While there has been increased convergence of competition law standards in the US and Europe in the area of merger review, enforcement efforts and outcomes seem to be increasingly diverging in the area of unilateral conduct. This panel will discuss this divergence, as evidenced by recent high-profile investigations, advise how to counsel multi-national companies operating across jurisdictions, and discuss what, if anything, could be done to lead to greater convergence.
