On April 2, 2018, Judge Koh in the Northern District of California issued a 50-page Daubert opinion addressing motions filed by both parties. The order was issued in advance of a trial on damages that is scheduled to begin on June 1, 2018. The June 2018 trial will be the third trial on the issue of damages for Samsung’s infringement of Apple’s design patents. The Court’s April 2018 Daubert decision involved the anticipated testimony of both parties’ damages experts and three experts on the relevant article of manufacture.
