CRA was retained by counsel for Omnicare to address allegations that it forgave or delayed Medicare Part A payments owed by Skilled Nursing Facilities to induce services for beneficiaries of other regulatory programs. CRA analyzed the viability of such allegations considering industry and regulatory structure, evaluated competition for the allegedly affected services, and assessed whether the proposed damages methodology was causally linked to the alleged behavior at issue. The case resolved with summary judgment in Omnicare’s favor.
