CRA’s Antitrust & Competition Practice supported the Competition Bureau in reviewing Nortera Foods’ proposed acquisition of B&G Foods Canada.
CRA Vice President Serge Moresi provided an expert report in support of the Bureau’s application to the Competition Tribunal for interim relief under section 104 of the Competition Act. The expert report found that the transaction likely met the concentration thresholds associated with the structural presumption under the amended Competition Act across multiple alternative market definitions. Following the Competition Bureau’s application to the Competition Tribunal to block the transaction, the merging parties abandoned the transaction.
