CRA’s Labor & Employment practice was retained by a software platform to underpaid missed meal and rest break premiums and overtime for a class of workers in California, resulting from the omission of non-discretionary stock grants from the regular rate of pay.
CRA’s research and analysis
The CRA team integrated data across HRIS, Restricted Stock Unit (RSU) vesting, payroll, and timekeeping systems to develop a complete picture of bonuses, equity vesting activity, earnings periods, and related wage‑statement reporting. CRA assisted with discovery, data to the opposing expert, and the estimation of back wages and penalties.
Outcome
Estimations of the back wages owed, in addition to interest, liquidated damages, and California/PAGA penalties, informed the employer’s approach to mediation and negotiations, ultimately supporting efficient and favorable resolution.
