Client issue
CRA client DoorDash was sued for patent infringement in the Eastern District of Texas, Texarkana Division. The Plaintiff, Fall Line, had licensed over 30 companies in the industry, including DoorDash’s two main competitors, Grubhub and UberEats.
CRA approach
Chris Bakewell provided expert testimony on licensing and economic issues, including usage and the value of the asserted patent. Chris explained that DoorDash’s usage of the asserted patent was minimal, to the extent that there was any. Chris also explained that FallLine’s licenses involved different economic circumstances than those claimed applied against DoorDash and limited value of the asserted patent, rebutting the damages theory of FallLine’s damages expert and other FallLine witnesses. Chris was assisted by Zach Gray and Tricia Mueller, PhD.
Client impact
The jury found that DoorDash did not infringe the FallLine Patent.
