Labour markets continue to sit at the centre of U.S. antitrust priorities. The FTC intensified its scrutiny of employer restraints with a major public inquiry into non-compete agreements, alongside targeted enforcement actions such as Gateway, requiring the removal of non-compete clauses affecting nearly 1,800 workers. Private litigation is also expanding. A wealth-management class action produced a $25.5 million settlement resolving allegations that major investment firms used no-poach practices that restricted employee mobility and depressed compensation for thousands of financial advisors. Meanwhile, courts are clarifying the limits of labour-market intervention, including the Sixth Circuit’s ruling in Pavia / NCAA, which addressed competitive access to athlete talent. Together, these developments suggest that labour-market conduct—non-competes, no-poach, monopsony effects, and restraints on worker mobility—will remain a central enforcement focus in the next months.
