Courts across Europe and beyond are currently issuing far-reaching decisions on royalty rate setting in patent law. The Unified Patent Court (UPC) has delivered its first FRAND decisions and introduced the anti-interim-license injunction (AILI) as a response to the UK courts’ interim license approach. At the same time, German courts are reinforcing a holistic framework for FRAND negotiations while resisting foreign interim licensing orders. Questions surrounding “long-arm” jurisdiction and global rate setting are becoming increasingly interconnected.
Meanwhile, the licensing of (standard-essential) patent portfolios for IoT devices, 6G connectivity, and the rapidly evolving AI landscape continues to raise complex and pressing challenges. The panel will examine where FRAND rate-setting stands today—and where it is headed.
