CRA economic experts Tiago Duarte-Silva and Robin Hart wrote an article for Law360 titled “Measuring And Mitigating Harm From Discriminatory Taxes.”
In the article the authors examine the April 2 Executive Order signed by President Trump highlighting US trading partners’ nontariff barriers, such as value-added taxes and practices affecting trade in digital products. The order follows a US Treasury Department report about discriminatory and extraterritorial taxes, but which is not yet public. These actions cite a never-invoked Internal Revenue Code section that allows the president to introduce reciprocal taxes on the citizens and corporations of countries that are deemed to impose discriminatory taxes on US citizens and corporations.
