David Duski

With more than two decades of experience, he has worked on matters involving patent, trademark, trade dress, and copyright infringement, as well as trade secret misappropriation, false advertising, breach of contract, fraud, and counterfeiting, among others.

Mr. Duski provides expert testimony and economic analysis in matters before the US federal and state courts and in arbitration proceedings, including matters before the American Arbitration Association. He advises plaintiffs and defendants on financial and economic issues, including lost profits, reasonable royalties, unjust enrichment, price erosion, commercial success, and prejudgment and post-verdict interest.

His experience spans industries including automotive, aviation, biotechnology, consumer products, energy, financial services, healthcare, information technology, medical products, pharmaceuticals, semiconductors, telecommunications, and other technology-intensive sectors.

Outside of litigation, Mr. Duski advises corporate clients on global licensing strategies, existing license portfolios, royalty compliance, and long-term commercial agreements. He also frequently speaks about intellectual property damages and licensing at universities and professional organizations.

Mr. Duski is a licensed Certified Public Accountant, Certified Licensing Professional, and Certified Fraud Examiner. He has been recognized as a leading expert witness by the IAM Patent 1000: The World’s Leading Patent Professionals from 2019 to the present and as a leading IP strategist by the IAM Strategy 300 in 2023. He also has been recognized by the Lexology Index, formerly Who’s Who Legal: IP, as a Recommended Expert Witness from 2023 to the present, a Thought Leader from 2025 to the present, and the Number 1 IP Expert in Illinois in 2026.

Prior to joining CRA, Mr. Duski led a national intellectual property consulting practice at a global public accounting and advisory firm.
