Kurt Strunk

Kurt Strunk is a vice president in the energy practice, with over 30 years of experience in international arbitration, complex commercial litigation, and regulatory proceedings.

Mr. Strunk is an expert economist working at the intersection of finance and energy. He has been retained as an expert to testify in arbitrations before the Permanent Court of Arbitration, the London Court of Arbitration, ICC, the International Institute for Conflict Prevention & Resolution, the American Arbitration Association, and ad hoc international arbitration. He has testified before energy regulatory commissions, tax court, bankruptcy court, and various other courts. His testimonies address a range of issues, including support for utility mergers and acquisitions, capital market conditions and the cost of capital, construction delay, industry practices, asset and contract valuation, breach-of-contract damages, the proportionality of stipulated liquidated damages provisions, tariffs, regulatory accounting, regulatory reform, trading and risk management, the just and reasonable standard and prudence. He has presented oral or written testimony on over 150 occasions.

In electric power, Mr. Strunk has advised governments, regulators, and energy companies on industry structure, regulation, and sector reform in North America, South America, Europe, Australia, Asia, and Africa. A significant share of his practice in recent years has focused on the energy transition, advising clients on transaction structuring and development of green power generation facilities.

In the oil and gas sectors, Mr. Strunk has consulted on rate matters, mergers and acquisitions, restructurings, contract disputes, valuation, trading, risk management, product pricing, financial structure, and cost of capital. He has served as an expert in regulatory hearings and has quantified damages in connection with the early termination of gas supply agreements.

Mr. Strunk’s assignments often require that he determine the appropriate return on equity capital for energy firms.  He routinely analyzes how those firms raise capital in debt and equity capital markets.
