CRA Competition expert advises on Tunney Act proceeding in HPE’s acquisition of Juniper

CRA expert, Dr. Elizabeth M. Bailey, provided multiple declarations on behalf of Hewlett Packard Enterprise (HPE) in conjunction with the Tunney Act proceeding in the US District Court for the Northern District of California, San Jose Division, related to the negotiated settlement accompanying HPE’s 2025 acquisition of Juniper Networks (Juniper). As part of the Tunney Act proceeding, a group of 12 States, and the District of Columbia intervened to participate in the Court’s review of that negotiated settlement agreement.

After a motion hearing held on March 23, 2026, Judge P. Casey Pitts of the Northern District issued an order on August 12, approving the United States’ motion for entry of the amended final judgment.

Dr. Bailey previously provided expert economic testimony on behalf of HPE and Juniper in connection with the lawsuit brought by the US Department of Justice (DOJ) seeking to block HPE’s $14 billion acquisition of Juniper. On June 28, 2025, the DOJ announced that it had reached a negotiated settlement agreement with HPE and Juniper that cleared the way for the transaction to close.

Dr. Bailey was supported by a CRA team that included Andrea Asoni, Yajing Jiang, and Alexandra Charbi, along with many others at CRA. The team worked closely with attorneys at Freshfields, including Julie Elmer and Jenn Mellott, who represent HPE.
