CRA expert’s national market definition adopted by federal court in real estate platform antitrust dispute

Dr. Debra Aron was engaged as an economic expert to provide antitrust analysis and testify in federal court on behalf of a residential real estate brokerage in a highly publicized matter involving real estate platform products.   

The plaintiff alleged unlawful restraint of trade and abuse of dominance. A highly contested issue in the case was geographic market definition. Dr. Aron concluded that the facts in the case supported a national geographic market. She found that, while there may also be local geographic markets, local geographic markets do not preclude a relevant national market. She concluded that the relevant nexus of competition best suited to analyzing the allegations in the case was the national market.   

The court found Dr. Aron’s analysis compelling, and ruled that the relevant geographic market for purposes of analysis of the antitrust allegations in the case was national.
