A CRA team was engaged to assess allegations of off‑the‑clock work and improper overtime calculations involving a class of resort employees. To address the full scope of the issues, CRA’s Kristen Backor, Vice President in the Life Sciences Practice & Director of the Market Research Center of Excellence, and CRA’s Hossein Borhani, Vice President in the Labor & Employment Practice, conducted complementary analyses that informed several key components of the case.
Dr. Backor provided expert testimony in a class action claim to determine the amount of off-the-clock work performed by resort employees. Her analysis consisted of surveying current employees to identify the types and prevalence of off-the-clock work, as well as evaluating the accuracy of employee timesheets.
Dr. Borhani calculated the appropriate regular rates for overtime pay by incorporating all forms of remuneration received by resort employees. His analysis included recalculating overtime premiums, crediting the resort for premiums already paid, and determining the remaining balance owed to employees.
The defendant sought to dismiss the case and compel arbitration. The court partially granted the motion, sending hundreds of individual claims to arbitration while retaining jurisdiction over others. CRA experts Dr. Backor and Dr. Borhani provided affirmative testimony through declarations submitted during the arbitration proceedings. The matter was ultimately resolved through settlement.
