Sush Jain is an economist with more than 20 years of experience providing economic consulting and expert testimony in matters involving intellectual property, false advertising, consumer class actions, and antitrust disputes.

Mr. Jain has analyzed economic damages in patent, trade secret, and trademark infringement matters, including lost profits, reasonable royalties, price erosion, and other measures of economic harm. His intellectual property experience spans a wide range of industries and products, including pharmaceuticals, electronics, and consumer products.

Mr. Jain has also served as a testifying expert in consumer class actions involving allegations of product misrepresentation, false advertising, and product defects. His work in these matters has focused on whether alleged conduct caused economic harm to consumers and, if so, how that harm can reliably be measured. He has evaluated a variety of proposed methodologies for measuring consumer harm, including conjoint survey-based damages models. In a recent matter, the court excluded the plaintiff’s damages expert and denied class certification, relying on Mr. Jain’s demonstration that the proposed conjoint-based damages methodology did not align with the plaintiff’s theory of liability.

In antitrust matters, Mr. Jain has assisted in the development of econometric analyses and contributed to expert reports addressing class certification, liability, and damages, including in matters involving allegations of price fixing.
